Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SocialBizHub software service (the "Service"), provided by CLIMB IT Solutions, Inc., a Florida corporation ("Company", "we", "us", or "our"). SocialBizHub is our product and brand name. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use the Service

You must be at least 18 years old (or the age of legal majority where you live) and able to form a binding contract to use the Service. If you use the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms.

2. What the Service does

The Service helps local businesses manage their online reputation and marketing. Depending on your plan, it may:

  • Aggregate reviews and ratings from third-party platforms, including Google, Airbnb, Hipcamp, RV LIFE, Tripadvisor, and Yelp, into one dashboard;
  • Generate AI-drafted review replies and social media content using Amazon Web Services' Bedrock AI service, for you to review, edit, and publish (or, where you enable it, auto-post after a grace period you control);
  • Publish content you approve to social and business-listing platforms you connect;
  • Send review-request messages to contacts you upload, and collect private feedback and public reviews from your customers;
  • Provide an AI-assisted webchat widget for your website; and
  • Provide website, SEO, and analytics tools for a website you connect.

Current plans, pricing, and included features are listed on our Pricing page and may change prospectively; changes never apply retroactively to a period you've already paid for.

3. Your account

You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us right away at support [at] socialbizhub.com if you suspect unauthorized use.

4. Subscriptions, billing, and cancellation

Paid subscriptions are billed through Stripe, our payment processor. By subscribing, you authorize us (via Stripe) to charge your payment method on a recurring basis (monthly or annual, as you select) until you cancel. There is no long-term contract: you can cancel anytime from your account settings, with no notice period and no cancellation fee. Monthly plans stop billing at the end of the current billing month; annual plans turn off auto-renewal and continue through the term you already paid for. Some early customers may be offered a "Founding Member" rate. That rate is a locked recurring price, not a one-time lifetime purchase — it applies only to your plan (not add-ons) and only for as long as your subscription stays continuously active without lapsing; it is described in more detail on the applicable pricing or offer page.

5. Content you provide us

You keep ownership of the content and data you provide, including your business information, guest/customer contact lists you upload for review-request campaigns, and messages exchanged through the webchat widget. You represent that you have the legal right to share any customer or guest contact information with us for the purpose of sending review requests, and that doing so complies with applicable law (including CAN-SPAM and similar rules) in your jurisdiction. You grant us a license to use this content solely to provide and improve the Service to you.

6. Third-party review platforms

We display ratings and review content that is publicly available on third-party platforms (Google, Airbnb, Hipcamp, RV LIFE, Tripadvisor, Yelp, and others we may add). We do not control, and are not responsible for, the accuracy of that third-party content, or for changes a third-party platform makes to its own terms, APIs, or availability, which may affect what we can show you.

Where you connect a social or business-listing account for publishing (for example Facebook, Instagram, Google Business Profile, LinkedIn, TikTok, YouTube, or Pinterest), that platform grants the Service a revocable authorization to act on your behalf. Platforms may revoke or expire that authorization at any time under their own security policies — for example after a password change, a security check, or a permissions change — and publishing to that platform will pause until you re-authorize the connection from within the Service. Where the connection to one platform is interrupted, we take reasonable steps to continue publishing to your other connected platforms and to notify you, but we are not responsible for content that is not published, or is published late, while a platform-side authorization is revoked, expired, or otherwise unavailable.

7. AI-generated content

Reply drafts, social captions, and similar output are generated by an AI model and may be inaccurate or inappropriate for your business. You are responsible for reviewing AI-generated content before it is published under your name or your business's name, except where you have explicitly enabled an automated posting setting.

The same applies to chat assistants: responses from the AI chat assistant on our website, and from webchat widgets the Service hosts, are AI-generated and provided for general information only. They may be inaccurate, are not offers or commitments, and do not modify these Terms or any published pricing or policy. Verify important details with our team (or, for a widget on a customer's website, with that business) before relying on them.

8. Acceptable use

You agree not to use the Service to:

  • Violate any law or third-party right;
  • Upload contact lists you do not have the right to use for the purposes described in these Terms;
  • Post or generate content that is fraudulent, defamatory, or that misrepresents a review as coming from someone who did not write it;
  • Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service; or
  • Resell the Service without our written permission.

9. Intellectual property

We own the Service, including its software, design, and branding. These Terms do not transfer any of that ownership to you. You may not copy, modify, or create derivative works of the Service except as the Service itself allows (for example, embedding a review widget on your own website as intended).

10. Termination

You may cancel your account at any time as described in Section 4. We may suspend or terminate your access if you materially violate these Terms, including the Acceptable Use section, after reasonable notice where practical.

11. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that third-party review platforms, AI output, or connected integrations will always be available or error-free.

12. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to the Service or these Terms is limited to the amount you paid us in the 12 months before the claim arose. Neither party is liable for indirect, incidental, special, consequential, or punitive damages.

13. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Florida, and both parties consent to the jurisdiction and venue of those courts. Before filing a claim, each party agrees to try in good faith to resolve the dispute informally by contacting the other.

14. Changes to these Terms

We may update these Terms from time to time. We'll update the "Last updated" date above, and for material changes we'll make a reasonable effort to notify active subscribers (for example, by email or an in-app notice) before the change takes effect.
